This guide covers Indian law, for businesses in India. Outside India, local tax rules come with a country pack.

The short answer

Since 22 Sep 2025 most goods and services in India carry GST at 5% or 18%, with a 40% rate for a short list of luxury and sin goods. Gold, silver and jewellery stay at 3%, and rough diamonds at 0.25%. The 12% and 28% slabs were largely removed; pan masala and tobacco moved to the new structure on 1 Feb 2026.

The structure since 22 Sep 2025

The 56th GST Council met on 3 Sep 2025 and recommended “a 2 rate structure with a Standard Rate of 18% and a Merit Rate of 5%; a special de-merit rate of 40%” (PIB release, copy on gstcouncil.gov.in). The new goods rates came in through Notification 9/2025-Central Tax (Rate) from 22 Sep 2025.

Rate (CGST + SGST, or IGST) What it covers
Nil or exempt Many unprocessed foods, and some items moved to nil in 2025, such as UHT milk, pre-packaged paneer, and chapati and roti
0.25% Rough or simply sawn diamonds and some precious stones
1.5% Some other diamonds, as listed
3% Gold, silver, pearls and jewellery
5% The “merit” rate: many daily-use goods and some services
18% The standard rate for most goods and services
40% The “de-merit” rate: a select few goods and services, such as larger cars and motorcycles above 350 cc, and from 1 Feb 2026 pan masala and tobacco products

Inside a state, split the rate half and half: 18% is 9% CGST + 9% SGST. Across states, charge the full rate as IGST. See place of supply.

How MyRecords helps

  • Rates are set per item through tax templates, so one change updates every new invoice for those items.
  • HSN and SAC codes on each item, printed on the tax invoice and summarised in the HSN table of the GSTR-1 file. With the AI Assistant on, Suggest HSN (AI) offers codes from the official list for you to pick.
  • Statutory updates are part of every AMC plan listed on the support and AMC page.
  • Old invoices keep the rate they were made with, so your returns for past periods do not change.

Look up a code with the HSN/SAC finder or work out tax with the GST calculator.

Ask a question
01Is there still a 12% or 28% GST rate?

Not as general slabs. Notification 9/2025 has no 12% schedule. Its 28% schedule held only pan masala and tobacco items, and it was omitted from 1 Feb 2026 when those moved to 40% (biris to 18%). Check your HSN code in the current notification, because special rates such as 3% and 0.25% remain.

02Which rate applies to an invoice raised around a rate change?

CGST Act section 14 decides it, using three dates: when the goods or services were supplied, when the invoice was issued and when payment was received. For example, if you supplied before the change but both the invoice and the payment came after it, the earlier of those two dates is the time of supply.

03Did restaurant GST change on 22 Sep 2025?

The 56th Council release did not change the restaurant rate. From 1 Nov 2026, Notification 06/2026-Central Tax (Rate) lets restaurants (other than at specified premises), hotels charging up to ₹7,500 a night and outdoor caterers take credit on input services bought from others in the same line of business. For hotels and outdoor caterers that credit is capped at tax worked out at the 5% rate.

04Where do I find the rate for my product?

Find its HSN code, then look it up in Notification 9/2025-Central Tax (Rate) as amended. Our free HSN/SAC finder is a starting point; confirm with the notification or your CA.

05Does MyRecords update rates for me?

Rates are set per item through tax templates, which you or our team update when the law changes. Statutory updates are part of every AMC plan. Check your item rates after any Council meeting.
